Gino D’Acampo complainants could be eligible for ‘thousands in compensation’

stating that those affected by his alleged misconduct may be entitled to significant financial compensation.

According to Thomas Beale, a partner and head of the bullying and harassment team at Bolt Burdon Kemp, the way production companies dealt with complaints against D’Acampo raises serious legal questions. Beale noted that Objective Media Group, which has produced several of D’Acampo’s shows, was reportedly aware of multiple allegations against him yet continued to work with him on new projects.

Beale stated, “The revelation that Objective Media Group were aware of numerous complaints about D’Acampo’s inappropriate sexual behavior, yet continued working with him on further TV programs, is extremely concerning.”

He added that while the production company has claimed that D’Acampo underwent “bespoke training” to address the issues, this did not appear to prevent further complaints from emerging. If the company was aware of allegations but failed to implement effective measures to protect employees, it could face legal consequences.

Those who believe they were harmed by D’Acampo’s alleged behavior may have grounds to seek compensation, either directly from the chef or from the employers responsible for overseeing his conduct.

Employer Liability and Industry-Wide Implications

Beale explained that complainants could choose to file a civil claim against D’Acampo himself, or alternatively, pursue legal action against ITV and its production companies. Under employment law, companies can be held vicariously liable for the actions of individuals they employ or work with, particularly if they fail to provide a safe working environment.

“If it transpires that D’Acampo’s employers were aware of the complaints against him and failed to take appropriate measures to protect their employees, this could open the door for survivors to pursue claims for compensation in the civil courts against the employers,” Beale said.

The unfolding situation could serve as a wake-up call for the television industry, urging production companies to establish stricter policies and procedures for handling workplace misconduct. Beale emphasized the need for better protections, saying, “It is imperative that organizations are armed with robust policies and procedures for dealing with complaints of misconduct.”

He also stressed the importance of supporting those affected by workplace misconduct. “Moving forward, it is crucial for any production company involved to ensure that employees receive appropriate support and compensation for their suffering.”
