Kim Kardashian sued by innocent man she wrongly labeled a death row inmate

Kim Kardashian is facing a defamation lawsuit from a man who claims the reality star mistakenly identified him as a convicted murderer on death row. 

The lawsuit, filed by Ivan Cantu, a Morgan Stanley project manager, accuses Kardashian of libel 

and slander after she incorrectly used his image in a social media post about a Texas inmate with the same name.

Mistaken Identity Leads to Lawsuit

The controversy began in February 2023 when Kardashian, 44, 

posted a plea on her Instagram story urging her followers to sign a petition to halt the execution of Ivan Cantu, a Texas death row inmate convicted of a double murder. 

However, instead of using a photo of the actual inmate, she mistakenly shared an image of a different Ivan Cantu—a completely innocent man who works in finance.

The innocent Cantu, who is 60 years old and resides in Westchester, quickly became aware of the mix-up when people began contacting him about the post. The lawsuit, filed by his attorney Greg Sobo, alleges that Kardashian’s post subjected him to embarrassment, emotional distress, and reputational harm.

Cantu’s legal team argues that with Kardashian’s massive social media reach—over 350 million followers at the time—the post spread misinformation on a global scale, associating him with a heinous crime he had nothing to do with.

Emotional and Professional Fallout

The lawsuit claims that Kardashian’s mistake caused Cantu severe distress, leading to anxiety, embarrassment, and even post-traumatic stress. Adding to the emotional toll, the lawsuit notes that Cantu was already grieving the loss of a close family member when the incident occurred, amplifying his suffering.

His lawyers argue that Kardashian acted negligently and recklessly by failing to verify the image before posting it. “There are few worse ways to harm someone’s reputation than falsely accusing them of murder,” the lawsuit states.

The mix-up forced Cantu to take to his own social media platforms to clear his name. He posted on Facebook, writing: “To all my friends and family, I am not getting executed. Some idiot who runs @kimkardashian used my picture of Ivan ‘Abner’ Cantu.”

Despite his efforts, the damage had already been done, according to his legal team. They claim he was unfairly subjected to “hatred, contempt, ridicule, and obloquy” due to the high-profile nature of Kardashian’s post.

Legal Battle and Kardashian’s Response

The lawsuit seeks compensatory damages for the harm caused to Cantu’s personal and professional reputation. His lawyers have requested a jury trial to determine the extent of damages he should receive.

Kardashian’s attorney, Michael Rhodes, has responded to the lawsuit, acknowledging the mistake but downplaying its impact. He stated that the incorrect image was removed almost immediately after the error was discovered.

“It was a simple mistake of using the public photo of another man with the same name to promote Kim’s longstanding commitment to the cause of criminal justice reform,” Rhodes said. “We’d prefer to resolve this without litigation, but of course, we will defend Kim as needed.”

Despite the swift removal of the post, Cantu’s lawyers argue that the damage had already been done. Given Kardashian’s massive influence, they claim that even a short-lived post had the potential to reach millions and inflict significant harm.

Kardashian’s Criminal Justice Advocacy

Kardashian has been an outspoken advocate for criminal justice reform in recent years, following in the footsteps of her late father, Robert Kardashian, who was a defense attorney in the infamous O.J. Simpson trial.

She has been studying law and working toward becoming a lawyer, focusing on prison reform and wrongful convictions. In 2018, she played a crucial role in securing the release of Alice Marie Johnson, a woman serving a life sentence for a nonviolent drug offense. Johnson was granted clemency by then-President Donald Trump after Kardashian personally lobbied for her case.

Critics argue that while Kardashian’s intentions may have been noble, the reckless use of an incorrect image underscores the potential dangers of social media activism without proper fact-checking.
